SUMMARY NOTICE OF PROPOSED SETTLEMENT HEARING IN IN RE: PAUL WYE NOCHUMOWITZ AND IN RE: MARSHALL RIEF The following Summary Notice is being issued by Kramon & Graham, PA, regarding the Paul Wye Nochumowitz and Marshall Rief bankruptcy proceedings: TO: ALL FORMER TENANTS (INCLUDING FAMILY MEMBERS AND MINORS OF FAMILY MEMBERS), RESIDENTS AND INVITEES OF THE FORMER TENANTS WHO MAY HOLD POTENTIAL LEAD PAINT CLAIMS AGAINST THE DEBTORS PAUL WYE NOCHUMOWITZ AND/OR MARSHALL RIEF (COLLECTIVELY, THE “DEBTORS”) AS A RESULT OF THE RESIDENTIAL RENTAL REAL PROPERTIES OWNED AND/OR LEASED BY THE DEBTORS IN BALTIMORE CITY, MARYLAND (THE “RENTAL PROPERTIES”) BETWEEN JANUARY 1, 1973 AND DECEMBER 31, 2000 (THE “CLAIMANTS”). ZVI GUTTMAN, CHAPTER 7 TRUSTEE, Plaintiff v. MARSHALL RIEF, et al., Defendants, Adv. Proc. No. 06-1579-JFS. YOU ARE HEREBY NOTIFIED, that the parties to the above-referenced actions (the Plaintiffs George Liebmann, Chapter 7 Trustee and Zvi Guttman, Chapter 7 Trustee (the “Trustees”) and the Defendants the Debtors, Amy Sue Nochumowitz, Jayne Hope Nochumowitz, Ross Adam Nochumowitz, Ethan Shale Nochumowitz, Fred Nochumowitz, Mildred Nochumowitz and Joanne Block Rief, DDS (the “Defendants”)) have reached a proposed settlement for a monetary payment in cash to the Trustees in exchange for, among other things, (a) releases by the Trustees and a bar order enjoining the Claimants from pursuing all future claims against the Defendants (i) relating to the Debtors’ prior ownership of the Rental Properties and (ii) the claims asserted in the adversary proceedings filed by the Trustees against the Defendants in the United States District Court for the District of Maryland (Adversary Proceeding Nos. WMN-06-2583 and WMN-06-cv-2823) (the “Enjoined Claims”) and (b) a discharge in favor of the Defendants from liability for these Enjoined Claims. A hearing will be held before the Honorable James F. Schneider, Courtroom 9C, United States Bankruptcy Court for the District of Maryland (Baltimore Division), 101 West Lombard Street, Baltimore, Maryland 21201 at 10:00 a.m. on December 15, 2008 (the “Settlement Hearing”) to determine whether the proposed settlement should be approved by the Court as fair, reasonable, and adequate. If you wish to object to the settlement, you must file your written objection with the United States Bankruptcy Court for the District of Maryland (Baltimore Division), 101 West Lombard Street, Baltimore, Maryland 21201 by December 5, 2008. Failure to file an objection within the time allowed may result in approval of the settlement and the granting of the relief sought with respect thereto. IF YOU ARE ONE OF THE CLAIMANTS, YOUR RIGHTS WILL BE AFFECTED. You should read these papers carefully and discuss them with your lawyer, if you have one in these bankruptcy cases.
